Employees of the Phenix City School System who are classified as “non-exempt” in accordance with definitions of the Fair Labor Standards Act shall be eligible for overtime pay for hours worked in excess of 40 hours per week. Employees may be compensated for overtime either by compensatory time off or by payment on payroll check, both computed at one and one-half times the regular rate. The worksheet in the school system begins at 12:01 a.m. on Saturday and concludes at 12 midnight on the following Friday. The school system shall meet all other provisions of the Fair Labor Standards Act or 1938 as amended which are applied to public school systems. Either compensatory time off or payment in payroll check must be used or paid during the following pay period. Any and all overtime pay must be approved by the Superintendent of Schools. The Board will comply with the Fair Labor Standards Act relative to minimum hourly wages and overtime pay for non-certified employees. The Board may under an agreement with an employee covered by the provisions of the Fair Labor Standards Act award compensatory time instead of overtime pay. Such agreement or understanding relative to compensatory time must be reached between the Board and an affected employee before performance of any work subject to overtime pay or compensatory time.
