PHOTO AND ART RELEASE FORM:

I hereby acknowledge, and understand that SPRAYFINGER/Peyton Scott Russell (hereinafter “SF”) may, from time to time, take photographs of my (or my child’s) participation in various Classes, seminars, or lectures taught by SF (collectively, “Class”).  I hereby grant SF all necessary rights to use my (or my child’s) image, as appropriate, for his promotional purposes, including but not limited to marketing, advertising, increasing awareness for SF, classes, and other related endeavors, including CD’s, DVD’s, video’s, fliers, brochures, posters, banners, signs, logos, billboards, t-shirts, clothing, and web sites subject to the following paragraph.

I hereby agree that I (or my child) will not be compensated for the use of such photographs in any way.  This waiver does not extend to any images of me (or my child) that are inappropriate or otherwise offensive to a reasonable person.

I further grant SF a non-exclusive world-wide, fully-paid, royalty-free license to use any art work that I (or my child) create during class, for the purposes of increasing awareness of SF, classes, and other related endeavors subject to the following sentence.  I (or my child) will retain ownership of and the rights to my original artwork; my provision of the art for any such promotion will be reasonable and wherever possible without losing the quality of the work, reproductions will be used.
 
I further understand that any work that not taken upon 30 days after completion of a class or the end of an exhibition is considered to be abandoned.  Any artwork so abandoned may be used by SF, at their sole discretion, in any manner SF sees fit, including for future exhibitions, rents, sales, installations, or may be destroyed, or discarded.

I HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE AND AGREE TO HOLD HARMLESS SF, owners and lessors of the premises on which the activity takes place from all liability, claims, demands, losses or damages on account caused or alleged in whole or in part by any act or omission of theirs in connection with the Classes, whether or not caused in whole or in part by their negligence, and further agree that if, despite this release, I or anyone on my behalf makes a claim against the above, I will indemnify, save and hold harmless each of them from any litigation expenses, attorneys fees, loss liability, damage or cost as may occur as the result of such claim.

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY;  IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE SHALL CONTINUE IN FULL FORCE AND EFFECT.

GRAFFITI ART CLASS RESPONSIBILITY STATEMENT AND INDEMNITY CONTRACT

I hereby acknowledge, and understand that SPRAYFINGER and Peyton Scott Russell (hereinafter collectively referred to as “SF”) teaches a style of art known as “Graffiti Art.” Graffiti Art is a fine visual art form that uses creative styles of lettering with incorporating the basic elements of art (line, space, shape, form, texture, color, and contrast) as well as the principals of design (balance, movement, pattern, emphasis, perspective, unity, and variety).

In teaching the techniques of Graffiti Art the Student will explore the history and origins of Graffiti Writing; specifically, how it evolved from vandalism into a widely accepted fine art and used in commercial advertising and other ways. The teaching material used will include videos, books, internet research, PowerPoint presentations and lectures. It is important to stress that while the origins of Graffiti Art link back to illegal activities including vandalism and trespassing (often to commit vandalism), SF does not condone, encourage, or support the Student or any Student to partake in any illegal activities or behaviors. In fact, as a condition to participating in the class: I hereby agree that I will not engage in illegal activities relating to graffiti vandalism and that I will only use the techniques I learn in a lawful way.

ASSUMPTION OF RISK AND FULL RELEASE

Student and Parent are hereinafter referred to collectively as “We”.

Parent and Student acknowledge that SPRAYFINGER and Peyton Scott Russell (hereinafter, along with any assistant instructors are collectively referred to as “Instructor”) provide art instruction and related matters (“Activities”). Parent and Student hereby express our desire for Student to participate in the Activities and understand that the Activities contain inherent risk when performed, including but not limited, to:

  • the various types of artistic materials used which may include but are not limited to different paints, aerosol paints, cleaning material, and other materials used for the Activities;
  • the tools used which may include but are not limited to scissors or other cutting tools, tools used for piercing or poking holes in other materials, tools for stamping, and other tools used for the Activities;
  • the techniques and steps used in performing the Activities including using ladders or scaffolding;
  • the fact that Activities may be performed in locations which can become dangerous quickly due to spills, dropped objects, tripping, or other events which may occur without much warning.

Accordingly, I as Student, understand that not only so the Activities contain risk, but that my actions are important to ensure a safe environment for the other students, and not only myself. Accordingly, I agree I assume all risk with the Activities and that I will participate in the Activities with care and follow all direction, including the safety directions, provided by Instructor.

Accordingly, I as Parent, understand that not only do the Activities contain risk but that my Student’s actions are important to ensure a safe environment for the other students and not only for my Student. Accordingly, I hereby agree that we assume all risk with the Activities and that I have read the above statement and understand the importance that my Student follows the same. If my Student does not follow the Instructor’s direction or causes an unsafe environment in anyway, I agree my Student may be pulled out of the Activities without a refund.

PARENT AND STUDENT HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE AND AGREE TO HOLD HARMLESS Instructor, the owners and lessors of the premises on which the Activities takes place from all liability, claims, demands, losses or damages arising from the Activities. If, despite this release, anyone on my behalf (including myself) makes a claim against the above, We agree to indemnify, save and hold harmless each of them from any litigation expenses, attorneys fees, loss liability, damage or cost as may occur as the result of such claim.

EACH PARENT AND STUDENT HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT WE ARE GIVING UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY; IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE SHALL CONTINUE IN FULL FORCE AND EFFECT.

MEDICAL TREATMENT AUTHORIZATION

In the event that Student requires medical attention while participating in the Activities for any reason, Parent and Student hereby expressly consent to minor treatment of minor cuts or scrapes. For anything deemed serious, We agree to the transporting of Student to a medical treatment facility and authorize the needed medical care. Furthermore, should it been deemed warranted, we furthermore hereby authorize the use of emergency transportation for Student to get to a medical treatment facility. Parent and Student will be responsible for all bills and expenses related to such actions. Parent and Student agree that the release provided above will apply to this situation fully.

Parent must sign is Student is under 18 years of age.
